Like many legal terms, probate is one of those words that can sound scary to the layperson. It doesn’t help that most people come across it for the first time when they are distressed, having recently lost a loved one. 

In a nutshell, probate allows you to handle someone’s affairs when they have passed on. If the deceased has a will, it is usually a named executor that applies for probate. Once you have a letter of authority granting you probate, you can carry out the wishes of the person who has passed away, according to their will.


It is possible to apply for probate without legal help, but given that it is essential to do things properly, most people prefer someone to guide them through the process. That is where we come in. When is Probate Required?

Probate is needed in England or Wales:

  • When there is owned property, houses, buildings or land
  • The bank or other financial institution asks for a grant of probate or grant of letters of administration
  • The Will requires a Grant of Probate
  • Depending on the size of the Estate and the value of individual assets
  • If there are joint assets

Once the probate application has been submitted, provided there are no complications, it can take between four to eight weeks to be granted probate. An estate which includes property, multiple shares or investments can take longer to finalise.
